- 1. I have completed the booking form to the best of my knowledge. I understand that a massage received at 3737 Lake Eastbrook STE 203 (collectively and individually the “Premises”) are for the sole purpose of stress reduction. If I experience any pain or discomfort during this session, I will immediately inform the technician performing my services (“Technician”) to adjust my experience to my level of comfort. I agree to keep the Technician updated as to any changes in my medical profile and understand that there shall be no liability on the practitioner’s part should I fail to do so.
- 2. I hereby acknowledge and agree that the Premises offers massage therapy services for its customers solely at my own risk. I understand and acknowledge that the Premises makes no claims as to the safety, results, or appropriateness of any program, activity, and/or experience for any particular individual. Furthermore, I understand that the Premises reserves the right to exclude any person from utilizing the facilities and/or participating in any activity or experience at the Premises for any reason whatsoever.
- 3. I further acknowledge and agree that use of the Premises, participation in programs, and receipt of experiences may involve a high degree of risk and at times may be hazardous to my health. I expressly agree to assume all risk associated therewith and agree to forever waive any and all claims and legal rights which I may have whatsoever, to the extent permitted by law, in connection with my use of the Premises, or my participation in any program, or my receipt of any experience. I understand that, before receiving any Premises experience, I should consult my physician and, in the event my health condition changes while I am receiving an experience, I agree to consult with my physician before resuming any and all activities/experiences at the Premises. I understand and agree that all suggestions and/or instructions made by the Technician or any staff concerning exercise, nutrition, or any experience are neither diagnostic nor prescriptive and that I should verify the same with my physician, and I will evaluate such instructions and/or suggestions independently. Notwithstanding the foregoing, I warrant and represent that I am in good health and that I can use the Premises facilities and participate in Premises programs and receive Premises experiences, without limitation.
- 4. In consideration of using the Premises facilities and/or participating in Premises programs and/or receiving Premises experiences, I agree, to the fullest extent permitted by law, to forever release, indemnify, defend and hold harmless the Premises, each of their respective subsidiaries and affiliates, and each of their respective agents, representatives, officers, directors, owners, contractors, and employees, including any and all Technicians (collectively the “Released Parties”) from and all claims and causes of action which I (or the below- mentioned minor) might otherwise have or be entitled to assert as a result of or related to any physical injury or otherwise, including without limitation death or property damage or loss sustained in connection with my use (or the below-mentioned minor’s use) of the Premises or participation in any program or receipt of any Premises, including, without limitation, claims and causes of action based on negligence, breach of warranty or breach of contract. I also agree to indemnify, defend, and hold harmless each of the Released Parties from any and all claims brought by third parties arising out of my (or the below-mentioned minor’s) acts, errors, or omissions.
- 5. If medical care is necessary during my visit, I hereby authorize the Technician to call for medical assistance for me or the below-mentioned minor and to transport the same to a medical facility or hospital in the event of an emergency, as reasonably determined by Premises staff. I further agree to be responsible for and pay all costs and expenses associated with any such medical care and/or transport, and I indemnify and hold harmless all Released Parties from any such costs.
- 6. If any portion of this release is held invalid, the remainder should not be affected and shall continue in full legal force and effect. That shall include modifying this release to allow any remaining claims to be waived, released, and indemnified against in the event that the inclusion of any particular provision is found to be invalid or contrary to public policy. The terms of this release shall continue from this date forever.
- 7. I agree that the releases set forth here shall be binding on my (or the below-mentioned minor’s) estate, heirs, administrators, and assignees. If I am executing this release on behalf of a minor, I represent and warrant that I am the minor’s parent or legal guardian. This document constitutes the entire agreement between Sponsor and me and supersedes any previous or contemporaneous discussions or agreements between us in respect of these matters.
I have the legal right to consent and, by accepting the liability waver on the booking form, I hereby consent to the terms and
conditions of this Release of Liability.
